Terms of Use

Welcome to MemoKid. By enrolling a student in our programs or using our website, you agree to the following terms and conditions.

MemoKid provides supplemental enrichment and accelerated learning programs, including Speed Math and Memory & Creativity. MemoKid is an enrichment center and not a licensed daycare facility or a primary educational institution. Supervision is provided only during scheduled class times within designated instructional areas.

Nature of Services

All curriculum materials, protocols and specialized mental calculation methods are the sole intellectual property of MemoKid. These materials are provided for the personal, non-commercial use of enrolled students only. Any reproduction, distribution or unauthorized teaching of MemoKid methods is strictly prohibited.

Intellectual Property

MemoKid is the US branch of the Mongolian Intellectual Academy (MIA). Upon enrollment confirmation, student data—including name, attendance and program progress—is registered within the MIA system to maintain academic records and certification. By enrolling, you acknowledge and consent to this process. This registration activates the student’s access to proprietary practice software maintained by MIA and its designated contractors.
 

  • Purpose: Software access is provided solely for the duration of the enrolled program to support classroom learning and at-home practice.
     

  • Access and Security: User accounts are personal and non-transferable. Login credentials must remain confidential and may not be shared outside the enrolled family.
     

  • Liability and Hosting: The software and student data are hosted and maintained by our headquarters in Mongolia. While we strive for consistent availability, MemoKid is not liable for temporary technical interruptions, bugs or data loss originating from international server maintenance or third-party contractors.

Data Management, Headquarters Registration and Software Access

MemoKid uses Brightwheel for enrollment, communication and payment processing. By using these services, you agree to abide by Brightwheel’s terms of service and privacy policies. MemoKid is not liable for technical interruptions or data handling issues originating from third-party platforms.

Third-Party Platforms (Brightwheel)

MemoKid may capture photographs, video and audio recordings of students during classes, competitions (such as the MemoKid Cup) and center events.
 

  • Usage: For students with a signed Media Release, these recordings may be used for instructional, historical or marketing purposes across MemoKid and Mongolian Intellectual Academy (MIA) websites, social media and promotional materials.

 

  • Identification: Unless otherwise requested via the enrollment form, MemoKid may recognize student achievements by using the student's first name and last initial. For official competition results or certificate displays, full names may be used.

 

  • Opt-Out: Parents may update their media preferences at any time by providing written notice to memokid.usa@gmail.com or memokid.chicago@gmail.com for Chicago area branch. MemoKid will make reasonable efforts to accommodate seating arrangements to exclude students who have opted out of media recordings during scheduled filming.

Media and Public Recognition

MemoKid organizes various internal and external competitions. By participating in these events, you acknowledge that:
 

  • Result Publication: Student names, scores and rankings may be published or shared within the MemoKid community and on public platforms to maintain tournament records.
     

  • Event Guidelines: Specific rules for each competition will govern how results are displayed. This may include full athlete standings or lists of top performers.
     

  • Finality: All scores and results recorded by MemoKid officials are final.

  • Deposit: A $200 deposit may be required to reserve a seat and if so, it will be applied to the tuition and fee balance.

 

  • Payment Plans: MemoKid does not offer monthly payment plans. However, MemoKid offers an interest-free automatic installment plan of four equal payments with the first payment due before the start of the program and the remaining payments due six weeks apart. Parents/guardians who wish to turn off the Brightwheel auto-pay must inform MemoKid administration before the due date.

 

  • Cancellations and Refunds: 

    • The one-time $25 new student registration fee is non refundable. 

    • Cancellation request before program start: Tuition payments can be refunded.

    • Cancellation request within 6 calendar days of program start: Tuition payments can be refunded after a deduction of an instruction fee of $43 per class.

    • Cancellation request within 7-14 calendar days of program start: Tuition refunds may be processed at MemoKid discretion, subject to a deduction of an instruction fee of $43 per class and a 15% administrative fee to cover overhead and opportunity costs.

    • Cancellation request beyond 14 calendar days of program start: Tuition refunds may be processed for documented emergencies (e.g., medical or relocation) at MemoKid discretion, subject to a deduction of an instruction fee of $43 per class and a 20% administrative fee to cover overhead and opportunity costs.

    • MemoKid reserves the right to cancel any class that does not reach a minimum of 6 students. In this event, families will be notified promptly and the tuition balance will be refunded in full after deduction of an instruction fee of $43 per attended class.

  • Late or Returned Payments: A $25 fee may apply to any payment returned due to insufficient funds or late payments.​

Academic-Year Program Enrollment and Tuition Policies

MemoKid provides structured training designed to help engage both brain hemispheres, improve processing speed or strengthen memory. However, individual results and academic and competitive outcomes depend on the student's adherence to the program, including engagement with the curriculum, timely attendance and at-home practice. MemoKid does not guarantee specific competitive rankings or grade improvements.

Program Expectations and Results

Students should arrive 5-10 minutes before class to use a restroom and prepare for learning. Prompt pickup is required as space and transition times are limited. We encourage regular communication with instructors regarding attendance and student progress.

Punctuality and Attendance

A required supplies list may be provided to parents and guardians. This may include items such as laptop access for practice, a binder, stationery and program-specific tools for at-home practice.

Learning Materials

Students and guardians are expected to maintain a respectful environment. MemoKid reserves the right to cancel a student's registration for repeated failure to comply with center policies, including punctuality, payment or conduct standards. Parents or guardians are liable for any damages caused by their child to the facility or equipment.

Safety and Conduct

Users of this website and MemoKid services may not engage in any act that:
 

  • Causes damage to MemoKid or any third party.

  • Disturbs public order or constitutes a criminal offense.

  • Damages the reputation or credit of MemoKid or its affiliates.

  • Distributes computer viruses or harmful programs.

  • Violates any local, state or federal law.

  • Creates a false impression of association with or endorsement by MemoKid.

  • MemoKid otherwise deems inappropriate and demands the termination of.

Prohibited Acts

  • Information Accuracy: MemoKid makes no warranty regarding the absolute accuracy or authenticity of all information contained on this website.
     

  • Liability: MemoKid is not liable for damages resulting from the use of this website or the information contained therein.
     

  • Service Alterations: MemoKid may alter, suspend or terminate website operations or services without prior notice and is not liable for any resulting consequences.
     

  • Communication Consent: By engaging with Brightwheel enrollment forms and/or providing your contact information, you authorize MemoKid to contact you via email, telephone or SMS/text messaging regarding enrollment, program updates, scheduling and emergencies. You are responsible for maintaining accurate contact details in the Brightwheel app. Standard message and data rates may apply.
     

  • Communication Failures: MemoKid is not responsible for inquiries that fail to reach our staff due to system malfunctions, incorrect email addresses or technical errors. If you do not receive a response, please contact us again at memokid.usa@gmail.com.

Disclaimers

To the maximum extent permitted by law, MemoKid and its instructors shall not be liable for any indirect, incidental or consequential damages arising from participation in the program. Parents agree to indemnify and hold harmless MemoKid from claims related to student actions outside of designated instructional time.

Limitation of Liability

These terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia. Any disputes arising under these terms shall be resolved exclusively in the courts of Fairfax County, Virginia.

Governing Law

MemoKid reserves the right to update these Terms of Use at any time. Continued participation in MemoKid programs constitutes acceptance of the updated terms.
